MEMORANDUM AND ORDER

CONNER, District Judge.

This is a civil rights action for injunctive and declaratory relief brought pursuant to 42 U.S.C. § 1983, 28 U.S.C. § 1343 and 28 U.S.C. § 2201, inter alia. Plaintiff, formerly a Correction Officer employed by the New York City Department of Correction, contends that he had achieved tenure in his position as a Correction Officer and that he was summarily dismissed without a hearing from his position in violation of his right to equal protection and procedural due process under the Fifth and Fourteenth Amendments.
