This case, which was removed to this Court from the Circuit Court of *152Laurel County, Ky., a county of this district, is submitted for judgment upon the question as to whether this Court has jurisdiction of the subject matter, which both defendants challenge by their respective Answers. The question is also raised by a motion for summary judgment.
