This is an action in conversion, brought by the plaintiff against the Maryland • Casualty Company, as surety on the official bond of Thomas P. Sherlock, sheriff of Broadwater county. It is alleged that on November 3, 1924, the sheriff, in disregard of the plaintiff’s ownership and claim thereof asserted to a certain Studebaker automobile, levied an execution upon the same, and thereafter sold it to satisfy a judgment entered in the district court of Lewis and Clark county, on June 2, 1922, in an action entitled Leopold Dobler, Plaintiff, v.
