MEMORANDUM OPINION
WILLIAM T. BODOH, Bankruptcy Judge.
This cause is before the Court on the Motions for Summary Judgment filed by Defendants DPAC, INC. (“DPAC II”), and MALCOLM K. SHEPPARD (“SHEPPARD”) in the above-captioned adversary proceeding.
PROCEDURAL POSTURE
THE OHIO CORRUGATING COMPANY filed a Petition for Relief under Chapter 11 of the Bankruptcy Code on Séptem-ber 30, 1985. Thereafter, but prior to January 13, 1986, THE OFFICIAL CREDITORS COMMITTEE made a demand upon OHIO CORRUGATING to take action to reverse a transaction claimed to have been fraudulent as to the creditors of Debtor.…
