In this proceeding, brought pursuant to article 78 of the Civil Practice Act, the petitioner seeks to review and annul a determination, dated June 6,1960 made by respondent Civil Service Commission, wherein it revoked the 1952 certification and appointment of petitioner as a patrolman. The determination made by respondent was based upon findings of fraud of a substantial nature in petitioner’s application for appointment to the position of patrolman and was made pursuant to the provisions of subdivision 4 of section 50 of the Civil Service Law.
