GARDNER, Circuit Judge.

This is an appeal from a summary judgment dismissing appellant’s action to confirm title to certain real property in them. The lands involved are certain lots in Min-turn, Arkansas, which have been sold to the Village Creek Drainage District for delinquent assessments, and which in turn have been sold by the Drainage District to ap-pellees Homer Shinault and W. H. Golden.
