Defendant appeals his convictions and sentences in three criminal cases1 which, although they involve different issues, have been consolidated for appeal.2
At defendant’s first trial, he was convicted by a jury for being an ex-convict in possession of a firearm with threatened use, ORS 166.270(1); ORS 161.610, and menacing. ORS 163.190. The trial court merged the convictions for sentencing and sentenced defendant to five years in prison and, pursuant to ORS 161.610, imposed a five-year mandatory minimum for threatening to use a firearm during the commission of a felony.
