This matter was tried before the court on the Trustee’s Motion to Determine Claim of Dernham Company and to Order Other Relief, as amended, and Dernham Company’s answer thereto. Subsequently, both the Chapter 11 trustee and the Dernham Company provided this court with memoranda in support of their respective positions and the unsecured creditors’ committee also filed a response.
