Appeals and cross appeal from an order of the Supreme Court, Erie County (Joseph D. Mintz, J.), entered July 16, 2003. The order, among other things, denied in part the motions of defendants Mark Fowalski, D.D.S. and Carlos Martinez, M.D. for summary judgment and denied that part of plaintiffs’ cross motion for partial summary judgment dismissing the affirmative defense of the statute of limitations asserted by defendant Carlos Martinez, M.D.
