Plaintiff recovered judgment against the defendant for $1,500 damages and $207.03 costs. Notice of entry of judgment was served November 6, 1929. In the opinion of the trial judge the verdict was small, but on motion of the defendant he granted a stay of execution until November 12, 1929, to enable the defendant to perfect an appeal. On November 13, 1929, the defendant filed with the clerk of the circuit court for Sauk county a purported undertaking but served no notice of appeal.
