In a proceeding pursuant to CPLR article 78 to review a determination of the Zoning Board of Appeals of the Village of Kings Point, dated January 9, 1990, which denied the petitioners’ application for a vari*589anee, the appeal is from a judgment of the Supreme Court, Nassau County (Yachnin, J.), entered June 21, 1991, which granted the petition, annulled the determination, and granted the petitioners a variance.

Ordered that the judgment is reversed, on the law, with costs, the determination is confirmed, and the proceeding is dismissed on the merits.
