The Vanderbilt Museum, petitioner in this article 78 proceeding, seeks an order removing the proceeding to the Surrogate’s Court, and the respondent American Association of Museums cross-moves for an order dismissing the petition upon the grounds that the court lacks in personam and subject matter jurisdiction, that the petition is untimely, and that the petition fails to state a cause of action.
