From a judgment for plaintiff, and an order denying its motion for a new trial, defendant appeals. Tbe cause was submitted on briefs of counsel.

On August 11, 1905, tbe plaintiff and defendant entered into a contract in writing, by tbe terms of wbicb tbe plaintiff agreed to sell and deliver to tbe defendant on board of cars at bis mill sawed pine lumber at stipulated prices per thousand, according to specified dimensions. Tbe amount to be so delivered was 6,000,-000 feet.
