I respectfully disagree with the majority’s treatment of court-martial voting procedures in imposing mandatory minimum life sentences. The majority opinion improperly extends the jurisdiction of this court in disregard for the independent military justice system established and supervised by Congress. The majority also misapprehends the limited nature of the review we are called upon to undertake in this case and seeks to announce and apply a new rule of constitutional procedure that is not within the relief we can properly provide on collateral review.
