This ease was before us at a former term and a judgment in favor of appellee was reversed for error on ruling's upon the admission of evidence and the refusal of instructions. The nature of the case and the statement of the pleadings are fully set forth in our former opinion, 223 Ill. App. 390.

It is contended by appellant that the court erred in refusing to instruct the jury to find appellant not guilty and likewise that the verdict of the jury was manifestly against the weight of the evidence.
