This is an appeal from an order of the City Court of Buffalo (Bellomo, J.) denying the motions of the defendants John Tutuska, Sheriff of Erie County and Ida Gelia to dismiss the complaint as against them for failure to allege a cause of action. The complaint sets forth that plaintiff Anna Foyster, while serving as a juror in the matter of the People v.
