Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain disciplinary rules.

After an inmate was stabbed several times and petitioner was identified as his assailant, petitioner was charged in a misbehavior report with assaulting an inmate, possession of a weapon, engaging in violent conduct and disturbing the order of a facility.
