A motion is made by the applicant for an order compelling the respondent to deliver to him the books and papers appertaining to the office of street commissioner of the city of Hew York.

The motion is made under 1 Revised Statutes, 125, § 56, which provides that when a person. appointed or elected to an office shall die, and books or papers appertaining to such office shall come to the hands of any person, the successor to such office may demand them; and on their being withheld, an order may be obtained on application to a justice of the Supreme Court for their delivery; and on the omission…
