(dissenting). — With due respect to the judgment of my brothers, I dissent from the majority opinion. Without going into all the questions discussed, I shall refer as briefly as may be to some of them. The case was carefully and thoroughly considered before, and a part of the evidence, at least, set out at some length. So far as I have been advised, nothing new has been presented.
