OPINION
RODNEY BERNARD, Jr., Bankruptcy Judge.
This matter is before the court on remand from the U.S. District Court for the Western District of Louisiana, Lafayette Divi*595sion. The question for consideration on remand is whether the subject 2.006-acre tract of land was dedicated to the public as a cemetery prior to the execution of the contested mortgage.
