On September 22, 2004, Sylvia Cohen (“plaintiff’) commenced a proposed class action against J.P. Morgan Chase & Co. and J.P. Morgan Chase Bank (“Chase”) (collectively, “defendant”), seeking damages for violations of Section 8(b) of the Real Estate Settlement Procedures Act of 1974 (“RES-PA”), 12 U.S.C. § 2607(b),1 and section 349 of the New York General Business Law (GBL).2 Now before the court is a motion by plaintiff for preliminary approval of a class action settlement between the parties, certification of the class for settlement…
