Appeal from Polk District Court. — Hon. Hugh Brennan, Judge. Action in equity to enjoin the levy and enforcement of certain special assessments for the construction of sidewalks. Bill dismissed, and plaintiff appeals.

In its original petition filed October 31, *6271903, the plaintiff sought to restrain the levy of the special assessment on the ground that the defendant, J. C. Likes, to whom the city had let the contract to build the walks, had failed in material respects to do the work according to the contract plans and specifications. In June, 1908, when the action had been pending nearly five years, an amendment to the petition was filed attacking the regularity and sufficiency of the ordinances, resolutions, and proceedings with reference to the improvement, and alleging that the city never acquired…
