TJOFLAT, Chief Judge:

The United States Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI) (collectively the Government) appeal from an order of the United States District Court for the Southern District of Florida compelling disclosure of certain documents relating to the Government’s criminal investigation of Joseph M. Nadler. Nadler seeks disclosure of the documents pursuant to the Freedom of Information Act (the FOIA or the Act), 5 U.S.C. § 552 (1988).
