It is ordered that the motion is decided as follows:

That branch of the motion by the City for dismissal of the complaint against the New York City Department of Transportation, New York City Department of Environmental Protection and New York City Department of Parks and Recreation is granted, there appearing no opposition to this branch of the motion.
