Appeal from an order of the Supreme Court (Ceresia, Jr., J.), entered March 27, 2002 in Rensselaer County, which denied a motion by defendant Bonded Concrete, Inc. for summary judgment dismissing the complaint against it.

On October 28, 1998, a concrete mixer truck owned by defendant Bonded Concrete, Inc. (hereinafter defendant) and being driven by plaintiff David P.
