Plaintiff Curtis J. Brown brought suit against defendant Gay-lord’s National Corporation seeking damages for false imprisonment. On September 23, 1983, defendant was served with summons and a copy of the complaint. No answer was filed by defendant. On December 5, 1983, defendant made a motion to open the default. Following a hearing, the trial court denied the motion to open default. In so ruling, the trial court declared that “the case may proceed to trial for the plaintiff to introduce evidence and establish the amount of damages ...” This appeal followed. Defendant…
