This cause comes before the Court on a Motion to Suppress filed by Defendant Marvin C. Ashburn. The Court is also in receipt of Defendant’s Brief in Support of Motion to Suppress.

Statement of the Facts

On April 13, 2000, Defendant Ashburn was driving a van in Greene County and was stopped by Deputy Sheriff Michael Hallahan on Route 33 near the intersection with Route 625.
