In 1908 the Northwestern Mutual Life Insurance Company filed its complaint in the Floyd Circuit Court against appellants and appellees, alleging that one Gebhart had previously died the owner of an insurance policy issued upon his life by said company in 1882, and that the same was payable to his estate or his assigns; that said defendants were each claiming the proceeds of said policy, and asked that it be allowed to pay said proceeds, amounting to $5,620, into court and that said defendants be required to interplead among each other to settle the ownership of said proceeds.
