Plaintiff and defendant are domestic corporations. The former was organized in January, 1895; the latter in February, 1896; and both are engaged in the manufacture and sale of mill and grain-cleaning machinery, at Silver Creek, in the county of 'Chautauqua. Charles E". Howes is the president of the defendant, and has been since its organization.
