This is a proceeding under an act entitled, “An Act in relation to Laying out, Enlarging, Straightening, or otherwise Altering Streets in the C.ity of Providence, passed February 22, 1854, and the several Acts in amendment thereof, or in addition thereto.”

Counsel for several parties interested have entered their appearance and moved to dismiss the proceeding, alleging that it can go no farther, because of the failure of the city council of Providence to elect to make the improvement described in the report of the commissioners of estimate and assessment, heretofore appointed by this court,…
