A motion was made by appellee’s counsel to strike out the bill of exceptions in this ease from the record. It is claimed that it was not filed within the time allowed for that purpose.

It appears that the original time expired with September 7, 1898. September 6th a stipulation was signed by appellee’s counsel, consenting to an extension of ten days from September 8th. Upon the 9th of September an order of court was entered, extending the time ten days from September 8th, in accordance, apparently, with the stipulation.
