This case raises the question of when an “obligation” to indemnify under a nonresidential lease “arises” for purposes of 11 U.S.C. § 365(d)(3).
I. Facts
The material facts are undisputed. Designer Doors, Inc. (“the Debtor”) leased a property from Lester C. and Jimmy L. Smull Family Trust (“the Landlord”). The Debtor agreed in the lease to keep the property free of any liens 1 arising from “work performed, material furnished, or obligation incurred” by the Debtor on the property.
