Vietz v. Texaco, Inc.
Nebraska Supreme Court
1Opinion of the CourtBoslaugh, J.
The plaintiff, Donald J. Yietz, was injured on March 21, 1968, when he was struck on the shoulder by an overhead door at the filling station where he was employed. The door closed suddenly when one of the two coil springs used to hold the door in a raised position broke unexpectedly. The principal defendants are Texaco, Inc., the owner of the station, and Yant Equipment Co., Inc., which had performed maintenance work on the door.
The trial court dismissed the action at the close of the plaintiff’s evidence. The plaintiff appeals contending that the trial court erred in dismissing the action.
