In a statement of claim filed in the municipal court of Chicago, Kathryn Mader alleged that on December 8,1938, she was shopping in Mandel Brothers Department Store and that she fell and was injured, due to the presence of a foreign substance on an escalator on which she stepped for the purpose of riding from one floor to another. Defendant denied that there was any slippery substance on the escalator, or that it was negligent, and that if such substance was on the escalator it did not allow the same to remain there; that defendant…
