Peachie Green was tried nonjury and was found guilty of possession of a controlled substance (heroin), possession of a controlled substance with intent to deliver and possession of drug paraphernalia. Post-trial motions were denied, and Green was sentenced to serve a term of imprisonment for not less than two (2) years nor more than four (4) years pursuant to the mandatory minimum sentencing provisions of 18 Pa.C.S. § 7508.
