Appeal from a judgment of the County Court of Broome County (Pelella, J.), rendered January 20, 2012, convicting defendant upon his plea of guilty of the crime of grand larceny in the third degree.

Defendant waived indictment and agreed to be prosecuted by a superior court information charging him with grand larceny in the third degree. At that time, defendant entered into a plea agreement whereupon he pleaded guilty to the above charge with his sentencing deferred pending his participation in the Binghamton Adult Drug Treatment Court program.
