MARR, Judge.

This action was brought by the appellant, as plaintiff in the court below, to recover damages of the defendant for false imprisonment. He alleged that the agent of the defendant, acting within the scope of his authority, wrongfully and maliciously caused plaintiff to be illegally arrested without warrant by a policeman of the city of Bonham and ejected from defendant’s depot and imprisoned in the city prison for a night and day.
