In December 2009, R.J. Schweiger, acting pro se, filed a complaint against the Town of Hurtsboro and its mayor, Rayford Tapley (referred to collectively as “the Town”), seeking a declaratory judgment and an injunction based on Schweiger’s allegations that the Town had breached its fiduciary duty to its citizens by failing to have a yearly audit performed as required by Ala.Code 1975, § 11-48-85, and by using moneys derived from the gasoline tax for purposes unrelated to road maintenance.
