KRUEGER, Judge.
Appellant was tried and convicted of an assault with intent to murder, and his punishment was assessed at confinement in the State penitentiary for a term of two years.
Two matters are brought forward for review. One relates to the insufficiency of the testimony to show a specific intent to kill, and the other relates to misconduct on the part of the jury.
