This is an appeal from a judgment awarding damages on account of an injury sustained by appellee while working as a switchman for appellant. In view of the fact that the jury deducted from the total amount of damages, which it found appellee sustained, the sum of five thousand dollars, stating in a special finding that it was “the proportion or just share thereof attributable to the negligence of plaintiff,” it necessarily found that appellee was guilty of contributory negligence, even though it specifically found otherwise in another special finding.
