The parties to this action will be referred to herein as plaintiff and defendant, as they appeared in the trial court.

The action was commenced by the plaintiff against the defendant on the 2nd of July, 1919. The action is a suit in replevin, for the purpose of obtaining possession of certain personal property in which the plaintiff claimed a special ownership because of a certain chattel mortgage executed by defendant in favor of one Charles P.
