I. Background
On January 8, 1993, plaintiff Christine Knox 1 (“Knox”) filed this civil action in the Circuit Court of Brooke County, West Virginia, against her employer Wheeling-Pittsburgh Steel Corporation (“Wheeling-Pittsburgh”). On February 11, 1993, Wheeling-Pittsburgh removed the action to this Court on the basis of federal question jurisdiction. On January 31, 1995, Wheeling-Pittsburgh filed a motion for summary judgment.
