Plaintiffs, George W. Wheatley and Hubert S. Raitt, Doing Business as W. & R. Construction Company, filed an action to recover damages for breach of a written contract, and for a Writ of Mandamus to force the individual defendants to perform official acts required of them which it is alleged they are under a legal duty to perform. The action was instituted as against the drainage district and certain individuals as commissioners of the drainage district, and is in two counts.
