1Opinion of the CourtConley, P. J.

The plaintiff sued the defendant and its driver, Clyde Fenwick, for damages by fire to a double drum portable drilling unit mounted upon a semitrailer which was being hauled from a point near Camarillo in Ventura County to a location near Delano in Kern County. By stipulation of the parties, the total amount of plaintiff’s damage by fire and the resultant loss of use was $16,754.61. The jury brought in a unanimous verdict for the defendants. Appellant contends that the court erred in refusing to give certain instructions requested by it and particularly on the subject of res ipsa loquitur.
