Appeal from a judgment of the County Court of Saratoga County (Scarano, Jr., J.), rendered May 14, 1996, upon a verdict convicting defendant of the crimes of driving while intoxicated and unlicensed operation of a motor vehicle in the first degree.

While assisting at an accident scene in the Town of Providence, Saratoga County, Deputy Sheriff Thomas Kennedy observed defendant’s vehicle approach with only one headlight illuminated.
