^The. complaint in this case contains three counts. The first is on, a negotiable promissory note.made by the defendant- to, lane Roberts for$lQ5, dated- August 22, IffSl, and- due one year after date, and indorsed and delivered by the payee to the plaintiff on the twenty-eighth *584day of July, 18S1. On this note two payments are alleged: Interest up to June 12, 1884, and twenty-two dollars paid January 22, 1887.
