—In an action, inter alia, for the imposition of a constructive trust, the defendants appeal, as limited by their notice of appeal and brief, from so much of an order of the Supreme Court, Dutchess County (Beisner, J.), entered July 2, 1992, as denied their cross motion to dismiss the plaintiffs’ complaint pursuant to CPLR 3211.

Ordered that the order is affirmed insofar as appealed from, with costs.
