MONCUR, J., pro tem. —

This is an appeal from an order denying a motion for judgment for defendant notwithstanding the verdict of the jury and from the judgment entered upon the verdict of the jury in favor of the plaintiff for *133damages for the death of plaintiff’s husband, alleged to have been caused as a result of negligence on the part of an employee of defendant. Charles F. Woodward was the husband of respondent herein and at the time of the accident was in the employ of appellant, Southern Pacific Company, and was employed in interstate commerce.
