Upon a promissory note for $1,369.13 'and interest, due August 29, 1895, Glide, on December 10, 1895, brought suit against Collins the maker, and Tanner payee and endorser, alleging that Tanner had endorsed it to him for value. Tanner filed a plea alleging: He was a mere surety on the note, which fact was known to the plaintiff.
