Mabry, J.:
The plaintiff in error was indicted at the spring term, A. D. 1891, of the Clay county Circuit Court for an assault upon a female child under the age of ten years, with intent feloniously and forcibly to carnally know *566and abuco her, and after arraignment was convicted of said offczsco.
